1. Introduction & Acceptance
These Terms of Service ("Terms") govern your use of the MyBodyAI platform and all related services (the "Service") operated by Aiclysm, a company registered in the Czech Republic (IČO: 73408280), with its registered office in Prague ("we", "us", "Aiclysm").
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
The Service is intended for users who are at least 15 years of age (in accordance with Czech law) and who have the legal capacity to enter into a binding agreement.
2. Description of the Service
MyBodyAI is a web-based health dashboard that connects to third-party wearable platforms (Polar, Strava, Withings, Fitbit, and Garmin once available) via their official APIs and computes 12 proprietary health indices from the collected data, including: Immunity, Recovery, Stress Load, Sleep Debt, Circadian Rhythm, ANS Balance, Illness Risk, Overtraining, Respiratory, Morning Energy, Sleep Quality, Cardiac Efficiency — plus Body Status, Biological Age across 8 domains, and Training Load analysis.
The Service is a personal wellness tool designed to help you understand trends in your wearable data.
3. Medical & Health Disclaimer
3.1 Not a Medical Device
The Service is NOT a medical device. It is not designed, intended, or authorized for use in the diagnosis, prevention, monitoring, treatment, or alleviation of any disease, injury, or medical condition. The Service has not been evaluated, cleared, or approved by any regulatory body, including but not limited to the FDA (U.S. Food and Drug Administration), EMA (European Medicines Agency), or SUKL (Czech State Institute for Drug Control).
3.2 For Informational Purposes Only
All health indices, scores, metrics, insights, and visualizations provided by the Service are for general informational and personal wellness purposes only. The health indices computed by the Service (including but not limited to Immunity Index, Illness Risk, and Recovery Index) are algorithmic estimates derived from wearable sensor data. They are NOT clinical measurements, medical diagnoses, or predictive medical tools.
3.3 Not Medical Advice
Nothing provided by the Service constitutes medical advice, clinical guidance, or a professional healthcare recommendation. The Service is not a substitute for professional medical judgment, diagnosis, or treatment. Always consult a qualified healthcare provider before making any health-related decisions.
3.4 No Guarantee of Accuracy
Health indices and metrics are subject to limitations inherent in the underlying sensor data, including signal quality, device calibration, measurement artifacts, and algorithmic assumptions. We do not guarantee the accuracy, completeness, reliability, or timeliness of any health index, metric, or visualization. Wearable sensor data may contain errors, gaps, or inaccuracies that affect computed indices.
3.5 User Acknowledgment
By using the Service, you expressly acknowledge and agree that:
- You understand the Service provides approximate, indicative values and not medical data
- You will not use the Service as a basis for medical decisions or emergency responses
- You will not rely on the Service instead of seeking professional medical advice
- You assume full responsibility for how you interpret and use the information provided
- The health indices (such as "Illness Risk" or "Immunity Index") are statistical estimates and do not indicate actual disease states or immune function
4. Account & Responsibilities
You are responsible for maintaining the security of your account, including your password. You must choose a strong password and not share it with anyone. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.
You may have only one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Third-Party Platform Integrations
The Service connects to third-party wearable platforms (Polar, Strava, Withings, Fitbit, and Garmin once available) through their official APIs using OAuth 2.0 authorization. By connecting a platform, you authorize us to retrieve your health data from that platform.
- We do not store your login credentials for any third-party platform
- Each platform's own terms of service and privacy policy continue to apply
- We are not responsible for data accuracy, availability, or outages on third-party platforms
- Third-party platforms may change or restrict their APIs at any time, which may affect our Service
- You can disconnect any integration at any time from your account settings
5.1 Provider-Specific Data Obligations
We comply with the terms of service and API agreements of each connected provider. Key obligations include:
- Strava: Data cached for a maximum of 7 days. Upon disconnection or user deletion, Strava data is removed within 48 hours. Strava data is never used for AI/ML model training. One user's Strava activity data is never displayed to other users.
- Withings & Fitbit: Data deleted promptly upon disconnection or revocation of access.
- Polar: Data properly attributed to source provider. Tokens revoked and data deleted upon disconnection.
5.2 Garmin Connect Integration
Garmin integration is currently pending API approval. The terms below will apply once the integration becomes publicly available.
The Service integrates with Garmin Connect via the official Garmin Health API under the Garmin Connect Developer Program Agreement. By connecting your Garmin account, you expressly consent to the transfer of your health and activity data from Garmin to our Service. Your data is transferred to Aiclysm for the purpose of computing personalized health indices displayed in the MyBodyAI dashboard. Data is processed algorithmically and retained only for the minimum period necessary to provide the Service.
Garmin's own privacy practices apply to data stored in Garmin Connect. Please review the Garmin Connect Privacy Policy for details on how Garmin processes your data.
Regarding Garmin-sourced data, the following applies:
- All data originating from Garmin devices is clearly attributed to "Garmin" as the source provider wherever it is displayed in the Service.
- We use OAuth 2.0 authorization exclusively. We never request, collect, or store your Garmin login credentials.
- Upon disconnection of your Garmin account or deletion of your MyBodyAI account, all Garmin-sourced data and access tokens are permanently deleted, including all backup copies.
- Garmin-sourced data is never sold, licensed, subleased, or shared with third parties. It is never used for advertising, insurance assessment, credit evaluation, or employment decisions.
- The Service does not use Garmin data in any life-critical applications where human life may be at stake.
- We do not claim any affiliation with, endorsement by, or sponsorship from Garmin Ltd. or its affiliates. "Garmin" and "Garmin Connect" are trademarks of Garmin Ltd.
5.3 AI Transparency Statement
The Service uses artificial intelligence algorithms to process your wearable data (including data from Garmin and other connected providers) and compute health indices such as Body Status, Biological Age, Illness Risk, and other metrics. Specifically:
- Your wearable data is processed by proprietary AI algorithms to generate personalized health scores, trend analysis, and predictive insights.
- Your individual data is NOT used to train general-purpose AI or machine learning models. AI processing is performed solely for computing your personal health indices.
- By using the Service and connecting a wearable platform, you consent to AI-based processing of your data for the purposes described above.
- You may withdraw this consent at any time by disconnecting the provider from your account settings or by deleting your account entirely. Upon withdrawal, all processed data is deleted.
5.4 Data Accuracy & Provider Warranties
Third-party provider names, logos, and trademarks are the property of their respective owners. We do not claim any affiliation with or endorsement by these providers. The accuracy and availability of data from each provider depends on their platform, your device, and factors beyond our control. We provide the data "as received" and make no additional warranties about its accuracy.
5.5 Abuse Reporting
If you believe the Service is being misused or your data is being handled improperly, please report it to info@aiclysm.com. We will investigate all reports promptly.
6. Pricing & Voluntary Support
6.1 Free Access
The Service is provided free of charge. All features, including all 12 health indices, biological age, predictive AI engine, personal pattern learning, and gamification, are available to every registered user at no cost. No features are locked behind any paywall.
6.2 Voluntary Support Subscriptions
Users may voluntarily support the ongoing development of MyBodyAI by purchasing a paid subscription. The following voluntary support tiers are available: €2.99/month, €14.99/6 months, or €24.99/year. These subscriptions do not unlock any additional features — they are purely voluntary contributions to support the project.
All payments are securely processed by Stripe, Inc. We do not store your full credit card details on our servers. By subscribing, you agree to Stripe's Terms of Service.
6.3 Right of Withdrawal
In accordance with EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from a voluntary support subscription within 14 days of purchase without giving any reason. To exercise this right, contact us at info@aiclysm.com. Upon withdrawal, you will receive a full refund via the original payment method.
6.4 Cancellation
You may cancel your voluntary support subscription at any time from the Settings page in the application. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the remaining period after cancellation, except as required by applicable law.
7. Intellectual Property
The Service, including its algorithms, health index methodology, user interface, and source code, is the proprietary property of Aiclysm and is protected by intellectual property laws. You may not reverse-engineer, decompile, or attempt to derive the source code or algorithms of the Service.
You retain ownership of your personal data. By using the Service, you grant Aiclysm a limited, non-exclusive, revocable license to process your data solely for the purpose of providing the Service.
8. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Health indices or metrics will be accurate, complete, or reliable
- Data from third-party wearable platforms will be continuously available
- The Service will meet your specific expectations or requirements
Nothing in these Terms excludes mandatory consumer warranties that cannot be excluded under applicable EU consumer protection law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Aiclysm shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Health decisions made based on information provided by the Service
- Inaccurate or incomplete data from wearable devices or third-party platforms
- Interruptions, failures, or changes to third-party platform APIs
- Loss of data, revenue, or business opportunities
- Physical injury, health complications, or emotional distress
Because the Service is currently provided free of charge, our total aggregate liability for any claims arising from or related to the Service shall not exceed €100 (one hundred euros), to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable EU or Czech law.
10. Service Availability & Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. We may update health index algorithms to improve accuracy, which may result in changes to your scores.
We do not guarantee any specific uptime or availability. Third-party platform availability is outside our control.
11. Termination
You may terminate your account at any time by deleting it through the application settings or by contacting us. We may terminate or suspend your account for cause, including violation of these Terms, fraud, or abuse.
Upon termination, your access to the Service will cease immediately. Your data will be deleted in accordance with our Privacy Policy.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.
For consumers residing in the EU, mandatory consumer protection rules of your country of habitual residence also apply (per Rome I Regulation, Article 6). You retain the right to bring proceedings in the courts of your country of residence.

13. General Provisions
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aiclysm regarding the Service.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
- No waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
- Language: These Terms are provided in English and Czech. In case of conflict, the English version prevails.
- Changes: We may update these Terms with at least 14 days' notice. Material changes require your affirmative acceptance. Continued use after the notice period constitutes acceptance of non-material changes.
- Indemnification: You agree to indemnify and hold harmless Aiclysm from any claims, damages, or expenses arising from your misuse of the Service, violation of these Terms, or infringement of any third party's rights.
